The employment contract (contract)

Petrova, aspirant, UrGAULabour legislation has fixed the position, according to which the workers, employees, professionals realize the right to work through the conclusion of an employment agreement (contract) on the work of the enterprise, institution, organization. Article 56 of the Labour Code defines a labor agreement (contract) as an agreement between the employer and the employee, under which the employee undertakes to perform work on a particular specialty, qualifications or position according to the internal regulations, and the employer shall pay the employee wages and provide working conditions provided by the legislation of the labor collective agreement and the parties' agreement. On the basis of this legislation on the definition of work of the labor contract parties are the employee and the employer. Employers may be organizations (legal entities) and capable citizens, such as an employment contract with a nanny, domestic worker, driver, and so on. N. At the conclusion of the employment contract (contract) the parties must meet certain requirements. Thus, the legal capacity to enter into an employment contract among citizens there is a general rule to 16 years, and only in exceptional cases can be employed persons 15 years of age. To prepare young people for productive labor, the employment of students in educational institutions to perform light work which is not harmful to health, in their free time when they reach the age of 14. As for the other side of the employment contract - enterprise (association), it can act as a party only if endowed with legal personality.
