To the question of typology of legal consciousness

Fomenko, soiskatel Uralskogo gosudarstvennogo agrarnogo universitetaThere is given the thesis about the impact of the types of worldview on types of legal conscience of personality caused by its common value orientations. The article reveals common and different features of the structure of world view and legal conscience as one of its characteristics, actualizes provisions of «idealistic» school of law, according to which the sense of justice is influenced by absolute (higher) values, whereas norms of state law are formed under the influence of functional, opportunistic values. Critical arguments against modernist notions, according to which every world view can vary indefinitely, are formulated. There is also expressed the idea that mature legal conscience, based on absolute values, promotes the formation of the integral personality, which is characterized by a stable outlook.
